Twarda 18, 00‑105 Warszawa (the "Company," "we," "us," or "our").
By visiting or using the Platform, you commit to observing these Terms and all relevant laws and regulations. We retain the sole authority to modify any provision of these Terms and to refresh this page at any time. Modifications become binding immediately upon publication. REVIEW THESE TERMS THOROUGHLY EACH TIME YOU ACCESS THE PLATFORM. THEY GOVERN YOUR RELATIONSHIP WITH US UNLESS A SEPARATE WRITTEN AGREEMENT HAS BEEN EXECUTED BETWEEN US. YOUR USE OF THE PLATFORM CONSTITUTES YOUR CONFIRMATION THAT YOU HAVE READ, UNDERSTOOD, AND ACCEPTED ALL OF THESE TERMS.
To access the products and services available on the Platform — including our APIs, software tools, developer resources, datasets, and documentation (collectively, the "Services") — you must be at least 18 years of age and legally capable of entering into a binding agreement. If you are using the Services on behalf of another individual or organization, you confirm that you hold the necessary authority to bind that party to these Terms. You are required to supply truthful and complete details when creating an account. Sharing your login credentials with anyone outside your organization is prohibited, and you bear full responsibility for any activity conducted through your account.
Our platform offers a complimentary tier ("Free Tier Account") that includes a set of free tokens; additional tokens are available for purchase. Token allocations per account may be subject to caps.
NeuroArtisan equips you with AI-powered tools for producing images, comics, illustrations, paintings, game assets, and a wide range of other visual content in a matter of minutes. Both standard and advanced AI models are available for generating production-grade creative assets.
We strive to deliver our services promptly and reliably. Once you complete a purchase — or begin using a free-tier plan — you gain immediate access to our full suite of tools directly on the Platform.
After engaging with our services, you will receive a confirmation via your registered email or within the Platform itself, detailing the scope of services provided and any relevant usage information. It is your responsibility to keep your login credentials secure; please notify us without delay at info@neuroartisan.com if you suspect unauthorized activity on your account.
Free-tier users may utilize the services within the boundaries defined for that tier. We aim to maintain uninterrupted access, except during planned maintenance windows or unexpected outages.
Your Content. You may submit material to the Services ("Input") and receive AI-generated results based on that material ("Output"). Together, Input and Output constitute "Content." As between you and us, and to the fullest extent allowed by law, you retain ownership of all Input. Provided you comply with these Terms, NeuroArtisan assigns to you all of its rights, title, and interest in the Output.
Users who create images on the platform hold complete ownership, copyright, and all associated intellectual property rights over those images.
Where images are kept private on the platform, NeuroArtisan may use them exclusively for the purpose of delivering the services to that user.
Where images are made publicly available, NeuroArtisan and its successors obtain a worldwide, perpetual right to use, reproduce, copy, adapt, modify, publish, transmit, create derivative works from, publicly display, publicly perform, sublicense, and distribute the text prompts and images you supply to the services, as well as any assets the service produces at your direction.
Content Similarity. Given the inherent nature of machine-learning systems, Output may not be unique to you; the Services may produce identical or substantially similar results for other users or for NeuroArtisan itself.
You agree to pay all charges applied to your account ("Fees") in accordance with the pricing and terms displayed on the relevant pricing page, or as separately agreed in writing. We may correct pricing mistakes or billing details, and we require a valid, authorized payment method on file. Charges are posted on a mutually agreed schedule, though we may reasonably adjust the billing date.
You grant NeuroArtisan, its affiliates, and our designated third-party payment processor(s) permission to charge your payment method for the applicable Fees. Should a payment fail, we will notify you in writing and may suspend your access to the Services until the outstanding amount is settled. All payments are non-refundable unless otherwise stated in this agreement.
We may revise our pricing at any time by posting a notice to your account or on the Platform. Updated prices take effect for all Fees billed after the stated effective date of the change.
NeuroArtisan responds to valid takedown requests under the Digital Millennium Copyright Act ("DMCA") and other intellectual property infringement claims. Users identified as repeat infringers will have their access to the Platform terminated. If you believe your work has been reproduced in a manner that constitutes copyright or trademark infringement, or that otherwise violates your publicity or intellectual property rights, you may file a takedown notice by emailing info@neuroartisan.com.
We provide you with a non-exclusive, non-transferable, non-sublicensable, revocable license to use the Platform for personal and commercial purposes as outlined in these Terms. The Platform and all associated content, features, and functionality — including but not limited to information, software, products, materials, APIs, text, graphics, images, video, and audio, as well as their design, selection, and arrangement — are the property of the Company, its licensors, or other content suppliers, and are protected under copyright, trademark, patent, trade secret, and other intellectual property and proprietary rights legislation.
By accessing the Platform, you represent and warrant — on your own behalf, on behalf of your users, and on behalf of any parties you represent — that you will not:
These Terms remain in effect for as long as you continue to access and use the Platform. You are free to discontinue your use at any time, with or without cause. We may revoke your access to the Platform immediately and without prior notice if you violate any provision of these Terms or if we suspect fraudulent, abusive, or unlawful conduct on your part.
You expressly acknowledge and accept that your access to and use of the Platform is entirely at your own risk. The Platform is made available on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the maximum extent allowed by applicable law, we, our subsidiaries, affiliates, and licensors disclaim all express and implied warranties with respect to the Platform.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER THE COMPANY, ITS AFFILIATES, NOR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS SHALL BE LIABLE FOR ANY DAMAGES WHATSOEVER, UNDER ANY LEGAL THEORY, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE PLATFORM.
OUR TOTAL AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT, OR (B) ONE HUNDRED US DOLLARS ($100).
These Terms, and any dispute arising from your access to or use of the Platform, shall be governed by and interpreted in accordance with the applicable laws, without regard to conflict-of-law principles.
